These terms govern your use of Sùil. By creating an account or using the app you agree to them.
Sùil is provided by Arbcura Technology LLC, 100 Newton Bridge Rd, Athens, GA 30607, United States.
1. What Sùil is
Sùil is a tool for recording tree risk assessments, appraisals and the evidence behind them. It structures your work, produces reports from it, and keeps your records available to you.
2. Your account
You need an account to use Sùil. Keep your credentials to yourself; you are responsible for what happens under your account.
You must be a professional using Sùil for professional purposes. It is not directed at consumers or at anyone under 18.
3. Sùil records your judgement. It does not supply it.
This is the most important thing on this page.
Every assessment, rating, recommendation and appraisal in Sùil is yours. You observe the tree, you form the opinion, you sign it, and you are responsible for it. Arbcura does not review, verify, approve or endorse anything you record, and nothing the software calculates or suggests is a substitute for your own professional judgement.
Where Sùil derives a figure, such as a diameter fitted from a 3D capture or a value from an appraisal method, it is a measurement or an arithmetic result offered for you to check. It is not a finding. The app says so where it matters, and the reports print the basis alongside the number for the same reason.
Arbcura is not an arboricultural consultancy and gives no arboricultural advice through this software.
4. Your records are yours
Your assessments, reports, photographs and data belong to you. We claim no ownership of them. We hold them to provide Sùil to you.
You are responsible for keeping your own copies. Sùil has an export that gives you everything in one file, at any time, from Settings. We retain completed assessments as described in the privacy policy, and we do that as a matter of practice rather than as an undertaking. We are not your archive of record and we do not warrant that any record will remain available.
When you close your account, your records are deleted. Sùil builds and downloads an export before the destructive action starts. If that download does not finish, the account is not deleted. The records then stay recoverable for 30 days. After that they are removed, and we do not keep a copy. If you want us to keep an archive after you leave, ask us before you close the account; we do that only by agreement and only for people who have asked.
We say this plainly because the consequence is real: if you close your account without keeping your export and a claim arrives years later, the record that would show what you observed and concluded is gone.
5. What you must not do
- Record data about people without a lawful basis for doing so.
- Upload anything you do not have the right to upload.
- Use Sùil to break the law, or to store data a court has ordered you to preserve elsewhere without keeping that copy too.
- Attempt to access another account's data, probe the service for vulnerabilities without telling us first, or interfere with its operation.

rather hear from you than not.
6. Data protection
For your account data, Arbcura is the controller.
For data about your clients that you record in Sùil, you are the controller and Arbcura is your processor. You decide what to collect and why. We process it only to provide Sùil to you, and we do not use it for any purpose of our own. If one of your clients asks what is held about them, you answer, and everything you need to answer is in the app.

7. Availability
We try to keep Sùil running and we do not promise that it always will be. There will be maintenance, and there will be faults. Because of that, and because of section 4, keep your own copies of anything you would be sorry to lose.
8. Fees
Sùil is currently free to download and use. We do not charge you anything today.
We expect to introduce paid plans. When we do, we will tell you in the app before any charge applies, and you will be able to keep using Sùil under whatever the free terms are at that point, or to leave with your records under section 4. We will not start charging an existing account without telling it first.
Where a payment is taken through Sùil, it is processed by Stripe. We do not receive or store your card details.
9. Ending it
You can leave at any time, from Settings, without contacting anybody.
We can end your account if you materially breach these terms, and we will tell you why and give you a reasonable opportunity to export your records first unless the breach makes that inappropriate.
The same 30 day deletion schedule applies to an account we close. The automatic browser download in section 4 applies when you use the in-app control; for an administrative closure, the export opportunity described above comes first unless the breach makes that inappropriate.
10. Warranty and liability
Sùil is provided as it is. We do not warrant that it will be uninterrupted, error free, or that it will meet any particular requirement. To the extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We are responsible for the software. You are responsible for the assessment. This follows from section 3 and it is the line that matters here. Arbcura is not liable for the consequences of an opinion you formed, a rating you gave, a tree that failed, or a decision your client took on your advice. Those are yours, they are what your professional judgement and your own insurance cover, and no software can carry them for you.
Neither of us is liable to the other for indirect, incidental, special or consequential damages, or for lost profits, however caused.
To the extent the law allows, our total liability arising out of or relating to these terms is limited to the greater of the amounts you have paid us in the twelve months before the claim, or one hundred United States dollars.
Nothing here limits liability that cannot lawfully be limited.
11. Changes
We may change these terms. If a change materially affects your rights we will tell you in the app before it takes effect, and continuing to use Sùil after that means you accept it.
12. Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Athens-Clarke County, Georgia, and you and we each consent to that jurisdiction.
